Standard Waiver

In exchange for participation in the activity of SLOW BAJA VINTAGE EXPEDITION (the "Activity") organized by SLOW BAJA, LLC of Chicago, Illinois 60607 and/or use of the property, facilities and services of SLOW BAJA, LLC, I ("Participant" or "I") enter into the following agreement (the "Agreement") with SLOW BAJA, LLC:

1. AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by SLOW BAJA, LLC, or the employees, representatives or agents of SLOW BAJA, LLC.

2. ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risks associated with the above described activity, INCLUDING THE RISK OF PERSONAL INJURY, BODILY HARM, DEATH, and DAMAGE TO PERSONAL PROPERTY. I assume full responsibility for these risks. I agree, on behalf of myself and my personal representatives, heirs, executors, administrators, agents and assigns, to RELEASE, DISCHARGE, HOLD HARMLESS, and COVENANT NOT TO SUE SLOW BAJA, LLC, and its employees, directors, officers, principals, agents, partners, shareholders, representatives, members, vendors and subcontractors for any claim, judgment, injury, loss, expense or damage arising out of my participation, use of the facilities, or presence during the Activity, whether caused by the fault of myself, SLOW BAJA, LLC, or other third parties, including acts of ordinary negligence. This also applies to the condition of any vehicle that I will be operating or occupying; I assume full responsibility for vehicle condition, operation, and the ability of the vehicle(s) to complete the Activity in a safe manner.

3. INDEMNIFICATION. I agree to indemnify and defend SLOW BAJA, LLC, against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my participation in, use of the facilities of, or presence at the Activity.

4. FEES. I agree to pay for all damages to the property or facilities of the Activity or SLOW BAJA, LLC, caused by any negligent, reckless, or willful actions by me.

5. APPLICABLE LAW. This Agreement and any legal or equitable claim that may arise from participation in the Activity shall be resolved under Illinois law.

6. NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. I further agree and acknowledge that SLOW BAJA, LLC, has offered to refund any fees I have paid for the event if I choose not to sign this Agreement.

7. ARM'S LENGTH AGREEMENT. This Agreement and each of its terms are the product of an arms' length negotiation between the Participant and SLOW BAJA, LLC. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, Participant and SLOW BAJA, LLC, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a particular party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity.

8. ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.
9. ARBITRATION. Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
10. PHOTO/VIDEO RELEASE. I grant SLOW BAJA, LLC, permission to use my likeness in a photograph or video in any and all of its publications, including but not limited to, all of SLOW BAJA, LLC,'s printed and digital publications, social media accounts, and website. I understand that I will receive no financial compensation.

I, the undersigned, wish for my Child (hereafter “Child”) to participate in the SLOW BAJA youth program (hereafter “Program”) on the date(s) and location(s) indicated above and, in consideration for my Child’s participation, I hereby agree as follows:

I acknowledge, understand, and appreciate that as part of my Child’s participation in the Program there are dangers, hazards, and inherent risks to which my Child may be exposed, including the risk of serious physical injury, temporary or permanent disability, and death, as well as economic and property loss. I further realize that participating in the Program may involve risks and dangers, both known and unknown, and have elected to allow my Child to take part in the Program. Therefore, I, on behalf of my Child, voluntarily accept and assume all risk of injury, loss of life, or damage to property arising out of training, preparing, participating, and traveling to or from the Program, except to the extent caused by SLOW BAJA’s negligence or willful misconduct.

I, on behalf of my Child, hereby release, waive, discharge, and covenant not to sue SLOW BAJA and any of its subsidiaries or partners (hereafter “SLOW BAJA”) from any and all liability as to any right of action that may accrue to my heirs or representatives for any injury to my Child or loss that my Child may suffer while training, preparing, participating, and/or traveling to or from the Program, unless caused by the negligence or willful misconduct of SLOW BAJA, its employees, or agents. I recognize that I may be giving up, among other things, certain limited rights to sue SLOW BAJA for injuries, damages, or losses my Child may incur by virtue of my Child’s participation in the Program. This agreement is binding on my heirs and assigns.

I, on behalf of my Child, furthermore release, indemnify, and hold harmless SLOW BAJA from and against any and all liability, actions, debts, claims, and demands of every kind whatsoever, specifically including, but not limited to, any present or future claim, loss, or liability for injury to person or property that my Child may suffer, for which my Child may be liable to any other person, that may or does arise out of my Child’s participation in the Program, excluding only claims arising out of SLOW BAJA’s own negligence or willful misconduct. I understand that SLOW BAJA accepts no responsibility for my Child’s personal property.

In the event of an accident or serious illness, I hereby authorize representatives of SLOW BAJA to obtain medical treatment for my Child on my behalf. I hereby hold harmless and agree to indemnify SLOW BAJA from any claims, causes of action, damages, and/or liabilities arising out of or resulting from said medical treatment. I further agree to accept full responsibility for any and all expenses, including medical expenses, that may derive from any injuries to my Child that may occur during his/her participation in the Program.

This RELEASE shall be governed by and construed under the laws of Illinois. I agree that any legal action or proceeding relating to this RELEASE, or arising out of any injury, death, damage, or loss as a result of my Child’s participation in any part of the Program, shall be brought only in Cook County, Illinois.

This RELEASE contains the entire agreement between the parties to this agreement and the terms of this RELEASE are contractual and not a mere recital. The information I have provided is disclosed accurately and truthfully. I have been given ample opportunity to read this document, and I understand and agree to all of its terms and conditions. I understand that I am giving up substantial rights (including my right to sue), and acknowledge that I am signing this document freely and voluntarily, and intend by my signature to provide a complete and unconditional release of all liability to the greatest extent allowed by law. My signature on this document is intended to bind not only myself and my Child but also the successors, heirs, representatives, administrators, and assigns of myself and my Child.
